Welcome to Defy. Please read these Terms of Service ("Terms") carefully. By accessing or using Defy's mobile application or related services ("Services"), you agree to be bound by these Terms. If you do not agree, please stop using the Services.

1. Eligibility

You must be at least 13 years old to use the Services. You are responsible for all activity that occurs under your account.

2. Your Account

You may sign in using email, Apple, or Google. You are responsible for maintaining the confidentiality of your login information. Notify us immediately at support@defykegel.com if you believe your account has been compromised.

We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.

3. License to Use the Services

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for personal and non-commercial purposes. All rights not expressly granted are reserved by Defy.

You may not copy, modify, distribute, sell, or lease any part of the Services.

4. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful purposes
  • Harass, bully, or target others based on religion, ethnicity, gender, or other protected characteristics
  • Upload or transmit content that is harmful, defamatory, threatening, hateful, violent, sexually explicit, or that promotes self-harm or terrorism
  • Interfere with or disrupt system integrity or security
  • Attempt to reverse engineer or extract source code
  • Use the Services to spread health misinformation or make unverified medical claims

We may restrict or remove content or accounts to protect users and uphold these standards.

5. Health Disclaimer

Defy provides general wellness and exercise information for educational purposes only. Content within the app does not constitute medical advice. If you have a medical condition, pelvic floor disorder, or are recovering from surgery, consult a qualified healthcare provider before beginning any exercise program.

6. User Content and Moderation

If you submit content (for example, feedback or journal text), you grant Defy a worldwide, non-exclusive, royalty-free license to host and process it solely to provide and improve the Services.

We may review, remove, or restrict content that violates these Terms or legal requirements. You may report concerns to support@defykegel.com.

7. No Professional Medical Advice

Nothing in the Services constitutes medical, therapeutic, or professional healthcare advice. Always consult a qualified physician or pelvic floor physical therapist for specific health concerns.

You use all content and exercise programs at your own discretion and risk.

8. No Guarantee of Results

Exercise outcomes vary by individual. Defy does not guarantee specific results from following any workout program in the app.

Use of such information is at your own risk.

9. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, store, and use your data.

10. Subscriptions and Payments

Some features require a paid subscription. Payments, billing, and refunds are handled by Apple App Store or Google Play.

Defy does not collect or store your full payment card information.

You can manage your subscription through your platform account settings.

11. Third-Party Services

We rely on trusted providers such as authentication, hosting, and AI processing services. While we take care in selecting them, we do not control their actions and are not responsible for failures caused by third parties.

12. Intellectual Property

Defy, including its name, logo, design, software, and content, is owned by Defy or its licensors and protected by intellectual property laws.

If you believe content infringes your rights, contact support@defykegel.com and we will review promptly.

13. Safety Measures and Enforcement

We may use automated and manual tools to reduce harmful behavior, misinformation, and abuse. We may take action, including feature restrictions or account termination, to protect users and comply with law.

14. Disclaimers

The Services are provided "as-is" and "as-available" without any warranties, whether implied or express, including merchantability, fitness for a particular purpose, or non-infringement.

Use of the Services is at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Defy is not liable for indirect, incidental, special, consequential, or punitive damages
  • Defy is not liable for lost data, lost profits, emotional harm, or reputational damage
  • Our total liability for any claim will not exceed: The greater of 50 USD or the amount you paid Defy in the 12 months before the event.

16. Indemnification

You agree to defend and indemnify Defy and its team from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.

17. Termination

You may delete your account at any time in the app.

We may suspend or terminate access for violations or legal reasons.

Sections such as disclaimers, limitations, and intellectual property survive termination.

18. Changes to the Terms

We may update these Terms from time to time. Updates become effective when posted. Continued use of the Services means you accept the revised Terms.

19. Export and Sanctions Compliance

You may not use the Services in violation of export control or sanctions laws.

20. Entire Agreement

These Terms constitute the complete agreement between you and Defy regarding the Services. If any part is found unenforceable, the remaining parts still apply.
